Mr. Sayyed Ebrahim Raisi, President of the Islamic Republic of Iran, H.E. Mr. Hossein Amir-Abdollahian, Minister for Foreign Affairs, and their colleagues in a helicopter accident on 19 May. The Secretary-General expresses his sincere condolences to the families of the deceased and to the Government and people of the Islamic Republic of Iran. OCCUPIED PALESTINIAN TERRITORY Turning to the situation in Gaza, the UN Office for the Coordination of Humanitarian Affairs say that Israeli bombardment continues to be reported across much of Gaza, as well as ground incursions and heavy fighting, especially in eastern Rafah in the south and Jabaliya in the north. More than 900,000 people – about 40 per cent of Gaza’s population – have been displaced over the past two weeks – including some 812,000 people from Rafah and more than 100,000 others in northern Gaza. To date, more than 75 per cent of the Gaza Strip – some 285 square kilometres – is under evacuation orders, amid escalating hostilities. Under international humanitarian law, civilians – whether they move or stay – must be protected. Wherever they are in Gaza, their essential needs, including food, shelter, water and health, must be met. As the large-scale displacement of civilians in Gaza continues, hundreds of thousands of people are experiencing extremely poor living conditions. UN humanitarian partners - working to provide shelter to people in Gaza - report that there are no tents and very few shelter items left for distribution. OCHA says people displaced from Rafah are seeking shelter in Khan Younis and Deir al Balah on any open land available, including access roads and agricultural land, and damaged buildings that have not been structurally assessed. Meanwhile, the UN has been working to provide water, sanitation and hygiene support in Gaza say that there are shortages of hygiene kits and water containers for households to collect and store water. This is especially critical given ongoing displacement. As more people move to areas lacking basic necessities such as water and food, the UN’s partners trying to maintain health care in Gaza are bracing for a further surge in communicable diseases and malnutrition. The escalating fighting in Rafah and in northern Gaza has severely disrupted nutrition services, according to the UN teams working on that part of the response. In Rafah, the World Food Programme’s partners have lost access to more than 100 distribution points for malnutrition prevention activities. The High Representative for Disarmament Affairs, Izumi Nakamitsu, today (20 May) told the Security Council that, in the context of the war in Ukraine, “importing, transit, producing, and exporting States must act responsibly at every step along the arms and ammunition transfer chain to prevent diversion, illicit trafficking and misuse.” Nakamitsu said, “over the last months, the provision of military assistance and transfers of arms and ammunition to the Ukrainian armed forces have continued” and have reportedly included “heavy conventional weapons such as battle tanks, armoured combat vehicles, combat aircraft, helicopters, large-calibre artillery systems, missile systems and uncrewed combat aerial vehicles, as well as remotely operated munitions, small arms and light weapons and their ammunition.” She said there have also been reports of “States transferring, or planning to transfer, weapons such as uncrewed aerial vehicles, ballistic missiles and ammunition to the Russian armed forces and that these weapons have been used in Ukraine.” The High Representative reiterated that “any transfer of weapons and ammunition must take place within the applicable international legal framework, including of course, relevant Security Council resolutions.” “Pre-transfer risk assessments, marking and record-keeping practices, as well as tracing capabilities,” she said, “are of utmost importance.”

The Prosecutor of the International Criminal Court (ICC) in the Hague, Karim A. A. Khan today (20 May) issued applications for arrest warrants for three senior leaders of Hamas, Yahya Sinwar, Mohammed Diab, and Ismail Haniyeh, and Israeli Prime Minister Benjamin Netanyahu and Minister of Defense Yoav Gallant for crimes committed on and after 7 October 2023. Khan said, “I can also confirm today that I have reasonable grounds to believe on the basis of evidence collected and examined by my office, that Israeli Prime Minister Benjamin Netanyahu and Minister of Defense Joav Galant bear criminal responsibility for the following international crimes committed on the territory of the state of Palestine from at least the 8th of October 2023. The crimes include starvation of civilians as a method of warfare, willfully causing great suffering, serious injury to body or health or cruel treatment, willful killing or murder, and intentionally directing attacks against a civilian population, as well as crimes against humanity of extermination and /or murder, persecution, and allegations of crimes of committing other inhuman acts. It's alleged that these crimes were committed in the context of the ongoing armed conflict and as part of a widespread and systematic attack against the civilian population of Gaza, pursuant to a state policy. Unfortunately, these crimes continue to this day. My office submits that these individuals, through a common plan, have systematically deprived the civilian population of Gaza of objects indispensable to human survival.” On the Israeli leadership, he said, “I can also confirm today that I have reasonable grounds to believe on the basis of evidence collected and examined by my office, that Israeli Prime Minister Benjamin Netanyahu and Minister of Defense Joav Galant bear criminal responsibility for the following international crimes committed on the territory of the state of Palestine from at least the 8th of October 2023. Those rights, however, do not absolve Israel of its obligations to comply with international humanitarian law, intentionally causing death, starvation, injury, and suffering to the civilian population, including so very many women and children. are criminal means to achieve military and political goals.” He said, “no foot soldier, no commander, no civilian leader, no one can act with impunity. Nothing on earth can justify willfully depriving human beings, including women, women and children, babies, the old and the young, of the basic necessities required for life. Nothing, nothing on earth can justify hostage taking or the targeting and killing of civilians. The independent judges of this International Criminal Court are the sole arbiters as to whether the necessary standard for the issuance of warrants of arrest have been met. The judges of the International Criminal Court must be now given the space to do their work and to dispassionately and objectively review the evidence that we have submitted.” To conclude, Khan said, “it's my strong conviction that if we do not demonstrate our willingness to apply the law equally, if it is seen as being applied selectively, we will be creating the conditions for its complete collapse. And in doing so, we would be loosening the remaining bonds that hold us together, the stabilizing connections between all communities, all individuals, the safety net to which all victims look to in times of suffering. This is the true risk we face at this perilous moment. Now more than ever, we must collectively demonstrate that international humanitarian law, the foundational baseline for human conduct during conflict, applies to all individuals and applies equally across situations addressed by my office and by the court. This is how we will prove, tangibly, in real terms, for all victims, that the lives of all human beings, wherever they may be, have equal value.”
