Chief Justice John Roberts said Monday that he believes “people have a misunderstanding” about how much the current U.S. Supreme Court is overturning precedent. Roberts said at Georgetown University Law Center that, compared to past makeups of the Supreme Court under different chief justices, the current high court was overturning precedent at a lower rate. Yet, he said, overruling precedent “is not necessarily a bad thing,” citing cases such as Brown v. Board of Education, a landmark and unanimous 1954 Supreme Court ruling that overturned the court’s “separate but equal” doctrine from the 1896 case Plessy v. Ferguson that permitted race-based segregation. “You need to have appropriate standards,” Roberts said. “If you do it willy nilly, there's no real sense in which law is established. … You have to have significant precedent about when you should overrule a precedent. The one case in which you shouldn't is simply because five members of the court think differently than five members of the court used to. You need a much more substantial justification for unsettling the law.” He went on to explain how the court determines when to overturn precedent, via stare decisis, a concept in the American legal system that courts and judges should generally uphold the rulings and decisions of past cases to keep the law consistent.
